Senator Tarr moved to amend the bill on page 1, section 10, after line 1, by inserting a new subdivision (1) to read as follows:

" (1) "Consent" means:

1. A free choice by an individual who has the capacity to make an informed decision.

(b) As it relates to sexual contact, implied consent exists between married partners except where one or more partners have explicitly and overtly withdrawn consent.

(c) Consent does not exist where an actor deliberately and intentionally misrepresents their true identity or biological sex to the victim.

(d) Consent does not exist where an actor knowingly and intentionally exposes another to a sexually transmitted disease without informing the victim in advance;";

And,

By renumbering the remaining subdivisions.
